I am 15 years of age, and I have been thinking about getting a tattoo, and I live in the state of Virginia, and the law says, .



"No person shall tattoo a person less than eighteen years of age, knowing or having reason to believe such person is less than eighteen years of age except (i) in the presence of the person's parent or guardian, or (ii) when done by or under the supervision of a medical doctor, registered nurse or other medical services personnel licensed pursuant to Title 54.1 in the performance of their duties. A person who violates this section is guilty of a Class 3 misdemeanor."



I'm a little confused by what that means.. So that means if one of my parents was with me, I could get one?

You have to have a parent present and you both have to provide valid I.D.'s with corresponding names and addresses. A consent form must be signed and notarized. Check with your local shops because the above "Option" is a law, and it is up to the shop or the artists descretion whether or not they tattoo minors.

Caine, what this means is that you cannot get a tattoo without parental consent. That is typical.

So, in order for the artist to know that the person giving you consent has the legal right to do so, you should have the following information:

The parent(s) should have valid photo ID.
You should have some sort of valid photo ID...if you don't drive, most schools now have photo ID.
A birth certicicate...so the artist can see that the person is your parent, or a court order that shows legal guardianship.

Most studios that tattoo minors will have a parental consent form, which will have to be filled out. In my studios, we take the numbers from the ID's and Birth Certificate, and record them on the release form for our protection, then photocopy the ID's and Birth Certificate and staple them together. That meets all criteria required by my state, as far as proving parental consent, and after reviewing laws in other states which allow for parental consent, it should satisfy their requirements, also.

It is up to the studio whether or not they will tattoo a minor, and if there is a cut-off age.

Bolfwad, there you go again, repeating what i just said! In my state, the legal tattooing of a minor is only legal if what "we" just said is provided, including,(for our records) A FUKKING NOTARIZED DOCUMENT for the health dept. and whoever else gives a fukk! And we have the power to notarize them here.

Not necessary here. We check both I.D.'s and notarize the document here at the shop and you can "legally" get your ink. But you may want to consider your age and size because of stretching as I've said before to dunce!

First:
The question was about Virginia law, and what it meant was necessary. There is no mention of anything having to be noterized in that law, and the articles I recommended will be sufficient in any state, as it proves the parent's identity, the child's identity, and that the parent and child are indeed, related.

Second: I can't imagine a notarized paper holding up in court, when the person who is in question NOTARIZED IT. That is a conflict of interest.
I don't know who came up with that insane bit of legislation, but they certainly weren't much into law.

in virginia im pretty sure you MUST be at least 16 yrs old WITH a parent and the form you MUST fill out (consent) MUST be notorized by a notary . your parent or legal guardian MUST have proper id as well as yourself. then you can get tattooed. If not, you MUST be 18
